General Terms and Conditions of DOMINFLATE Germany

§1 Applicability to Entrepreneurs and Definitions

(1) (1) The following General Terms and Conditions apply to all deliveries between us and a consumer in their version valid at the time of the order.

A consumer is any natural person who enters into a legal transaction for purposes that predominantly are neither commercial nor independent professional activities (§ 13 BGB).

§2 Formation of a Contract, Storage of the Contract Text

(1) The following provisions on the conclusion of the contract apply to orders via our online shop https://www.dominflate.de / https://www.dominflate.com.

(3) The presentation of goods in our online shop does not constitute a legally binding contract offer on our part but are merely a non-binding invitation to the consumer to order goods. By ordering the desired goods, the consumer makes a binding offer to conclude a purchase contract.
(4) Upon receipt of an order in our online shop, the following rules apply: The consumer submits a binding contract offer by successfully completing the ordering procedure provided in our online shop.

The consumer can return to the page where the customer's details are captured before the binding submission of the order by pressing the "back" button contained in the Internet browser used by him after checking his details to correct any errors or by closing the Internet browser to cancel the ordering process. We confirm the receipt of the order immediately by an automatically generated email ("order confirmation"). With this, we accept your offer.

§3 Prices, Shipping Costs, Payment, Due Date

(1) The indicated prices do not include the legal VAT (small business regulation) and other price components. Additional shipping costs may apply.

(2) The consumer has the option to pay by prepayment, PayPal, credit card.

(3) If the consumer has chosen to pay in advance, he/she is obligated to pay the purchase price immediately after the conclusion of the contract. Insofar as we deliver by cash on delivery, the due date of the purchase price claim arises upon receipt of the goods.

§4 Delivery

(1) Unless clearly stated otherwise in the product description, all items we offer are ready for immediate shipment. The delivery occurs here at the latest within 5 business days. The period for delivery begins in the case of payment by prepayment on the day after the payment order to the bank responsible for the transfer and for all other payment methods the day after the conclusion of the contract. If the deadline falls on a Saturday, Sunday, or public holiday at the place of delivery, then the deadline ends on the next working day.

(2) The risk of accidental loss and accidental deterioration of the sold item also passes to the buyer only when the item is handed over to the buyer.

§5 Reservation of Ownership

We reserve the ownership of the goods until full payment of the purchase price.

The cancellation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has taken possession of the goods.

To exercise your right of cancellation, you must inform us
by means of a clear statement (e.g., a letter sent by post, fax, or email) of your decision to cancel this contract. You may use the attached model cancellation form, but it is not obligatory.

Consequences of Cancellation

If you cancel this contract, we must reimburse all payments we have received from you, including delivery costs (except for additional costs resulting from choosing a type of delivery other than the least expensive standard delivery offered by us), without undue delay and at the latest within fourteen days from the day we receive the notification of your cancellation of this contract. We will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise; in no case will you be charged any fees for this reimbursement.

We may withhold reimbursement until we have received the returned goods or until you have provided proof that you have sent back the goods, whichever is earlier.

You must send back or hand over the goods to us without undue delay and in any event not later than fourteen days from the day on which you inform us of the cancellation of this contract. The deadline is met if you send back the goods before the period of fourteen days has expired.

You will bear the direct costs of returning the goods.

§9 Disclaimer

The DOMINFLATE COLLAR is offered and sold as a novelty/cosplay item. We strongly advise against using DOMINFLATE as a tool to reduce breathing capacity or for any other practice that could lead to the restriction of physical integrity. DOMINFLATE can be precisely adjusted to the individual desired size and must not be tightened beyond that. We recommend using DOMINFLATE exclusively in an uninflated state.

§10 Contract Language

The exclusive contract language is German.
